Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the hosting services, infrastructure, and network resources provided by CartOS Hosting, a service operated by Salloq Software ("Salloq," "Company," "we," "us," or "our"). This AUP is incorporated into and forms a part of our Terms and Conditions.

All customers, users, and visitors of CartOS Hosting ("you" or "your") must comply with this AUP. You are responsible for the actions of anyone you allow to use the Services under your account, including sub-users, employees, contractors, clients, and any other third parties.

Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without prior notice and without refund. CartOS Hosting reserves the right to take any action it deems necessary to protect its network, infrastructure, and other customers.

1. Prohibited Content

You may not use CartOS Hosting services to host, store, display, distribute, transmit, or link to any of the following types of content. This list is illustrative and not exhaustive; CartOS Hosting reserves the right to determine, in its sole discretion, whether any content violates this AUP.

1.1 Illegal Content

  • Any content that violates applicable federal, state, local, or international laws or regulations;
  • Content that facilitates, promotes, or instructs in the commission of illegal activities;
  • Controlled substances, illegal drugs, or drug paraphernalia sales or promotion;
  • Unlicensed gambling operations or online casinos operating in violation of applicable law;
  • Counterfeit goods, fraudulent products, or deceptive business practices.

1.2 Harmful & Abusive Content

  • Child sexual abuse material (CSAM) or any content that sexually exploits, endangers, or depicts minors — this constitutes an absolute zero-tolerance violation and will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement immediately;
  • Content that promotes, incites, or glorifies violence, terrorism, or violent extremism;
  • Content that constitutes harassment, threats, stalking, doxxing, or intimidation of any individual or group;
  • Content that promotes hatred, discrimination, or violence based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics;
  • Non-consensual intimate imagery (revenge pornography);
  • Content that promotes self-harm or suicide.

1.3 Malicious Content

  • Malware, viruses, trojans, worms, ransomware, spyware, adware, keyloggers, or any other malicious software or code;
  • Phishing pages, spoofed websites, or any content designed to fraudulently obtain personal information, credentials, or financial data;
  • Command-and-control (C2) servers, botnet infrastructure, or exploit kits;
  • Software cracks, keygens, license bypasses, or tools designed to circumvent security measures or access controls.

1.4 Infringing Content

  • Content that infringes on copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any party;
  • Pirated software, media, music, movies, e-books, or other copyrighted works distributed without authorization;
  • Torrent trackers, warez sites, or link farms directing users to infringing content.

1.5 Adult Content

  • Pornographic, sexually explicit, or obscene material;
  • Escort services or solicitation of prostitution;
  • Live adult webcam services.

2. Prohibited Activities

The following activities are strictly prohibited on CartOS Hosting infrastructure, regardless of whether the content itself is hosted on our servers:

2.1 Unauthorized Access

  • Attempting to gain unauthorized access to any server, account, network, system, or data, whether owned by CartOS Hosting, other customers, or third parties;
  • Circumventing, disabling, or interfering with any security features, access controls, or authentication mechanisms;
  • Using the Services to probe, scan, or test the vulnerability of any system or network without explicit written authorization from the system owner;
  • Intercepting, monitoring, or sniffing network traffic not intended for your account.

2.2 Denial of Service & Network Attacks

  • Launching, facilitating, or participating in denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against any target;
  • Intentionally flooding, mail-bombing, or overwhelming any server, network, or service;
  • IP spoofing, packet manipulation, or forging of any TCP/IP packet header or routing information;
  • Operating or participating in any amplification or reflection attacks.

2.3 Fraud & Deception

  • Identity theft, impersonation, or misrepresentation of your affiliation with any person or entity;
  • Operating fraudulent e-commerce sites, advance-fee schemes, Ponzi schemes, or pyramid schemes;
  • Creating accounts under false identities or providing fraudulent billing information;
  • Using the Services to facilitate financial fraud, credit card fraud, or wire fraud.

2.4 Mining & High-Compute Abuse

  • Cryptocurrency mining of any kind, including but not limited to CPU-based, GPU-based, and browser-based mining;
  • Running background processes that consume a disproportionate share of shared server resources;
  • Using hosting accounts to perform brute-force attacks, password cracking, or hash-breaking operations.

2.5 Reselling & Unauthorized Redistribution

  • Reselling, sublicensing, or redistributing CartOS Hosting services or resources without prior written authorization;
  • Operating a web hosting company or providing hosting services to third parties using your CartOS Hosting account unless explicitly authorized under a reseller arrangement.

3. Email & Anti-Spam Policy

CartOS Hosting maintains a strict zero-tolerance policy on spam. Violations of this email policy are treated with the highest severity and will result in immediate account suspension.

3.1 Prohibited Email Practices

  • Sending unsolicited bulk email (spam) of any kind, including commercial, political, religious, or any other unsolicited messages;
  • Sending email to recipients who have not explicitly opted in to receive communications from you;
  • Sending email using forged headers, fraudulent "From" addresses, or deceptive subject lines;
  • Harvesting, scraping, or collecting email addresses from websites, directories, or other sources without consent;
  • Using purchased, rented, or third-party email lists;
  • Operating open mail relays or open proxies on CartOS Hosting infrastructure;
  • Sending messages that do not comply with the CAN-SPAM Act, GDPR, CASL, or other applicable anti-spam legislation.

3.2 Email Requirements

All email sent from CartOS Hosting infrastructure must:

  • Be sent only to recipients who have provided verifiable, affirmative consent (opt-in);
  • Include a clear and functional unsubscribe mechanism that is honored within ten (10) business days;
  • Include the sender's valid physical mailing address;
  • Accurately identify the sender in the "From" field;
  • Use truthful, non-deceptive subject lines;
  • Comply with all applicable email and electronic communications laws.

3.3 Mailing List Standards

If you operate mailing lists on CartOS Hosting infrastructure, you must maintain verifiable records of each subscriber's opt-in consent, including the date, time, source, and method of consent. You must process unsubscribe requests promptly and maintain suppression lists of individuals who have opted out.

3.4 Email Volume & Sending Limits

CartOS Hosting may impose reasonable sending limits on email accounts to protect the deliverability reputation of our mail servers and IP addresses. Customers requiring high-volume email delivery should contact us about dedicated or transactional email solutions.

4. Resource Usage & Fair Use

4.1 Shared Hosting Resources

CartOS Hosting operates a shared hosting environment in which server resources (CPU, memory, disk I/O, network bandwidth) are shared among multiple customers. You agree to use these resources responsibly and in a manner that does not negatively impact other customers or the overall performance and stability of the shared infrastructure.

4.2 Fair Use Guidelines

While we provide generous resource allocations, the following are considered violations of fair use on shared hosting plans:

  • Running persistent background processes, daemons, or long-running scripts unless your Plan explicitly allows it;
  • Consuming more than your fair share of CPU time, memory, or I/O in a manner that degrades performance for other customers;
  • Running resource-intensive applications such as game servers, media streaming servers, or real-time video transcoding on shared hosting plans;
  • Using your hosting account primarily as a file storage, backup, or archive service rather than for active website hosting;
  • Running automated scripts, bots, or cron jobs at excessive frequencies that place undue load on shared resources.

4.3 Resource Limits & Overages

Each Plan includes defined resource allocations. Usage exceeding Plan limits is subject to overage charges as described in our Terms and Conditions. We reserve the right to throttle, suspend, or restrict resource access if your usage negatively impacts the shared hosting environment, regardless of whether overage charges apply.

4.4 Notification & Remediation

In most cases, we will attempt to notify you of resource usage issues and provide an opportunity to remediate before taking enforcement action. However, if your resource usage poses an immediate threat to the stability or availability of the shared infrastructure, we may take immediate action without prior notice, including throttling, suspending, or restricting your account.

5. Security & Vulnerability

5.1 Your Security Responsibilities

You are responsible for the security of your account, your applications, your websites, and all content hosted under your account. This includes:

  • Keeping all software, scripts, plugins, themes, and applications up to date with the latest security patches;
  • Using strong, unique passwords for all accounts and changing them regularly;
  • Implementing appropriate access controls and permissions for files, directories, and databases;
  • Regularly reviewing and auditing your hosted content for vulnerabilities, malware, or unauthorized changes;
  • Properly securing any forms, upload functionality, or user-input mechanisms against injection attacks, cross-site scripting (XSS), and other common web vulnerabilities.

5.2 Compromised Accounts

If your account or any website hosted under your account is compromised (hacked, defaced, infected with malware, or otherwise abused by an unauthorized party), we may suspend your account to protect our infrastructure and other customers. It is your responsibility to clean up the compromise, identify and remediate the vulnerability, and request reinstatement. We may require evidence of remediation before restoring access.

5.3 Vulnerability Disclosure

If you discover a security vulnerability in the CartOS Hosting infrastructure, please report it responsibly to security@cart-os.com. Do not attempt to exploit, test, or demonstrate the vulnerability against production systems or other customers' accounts.

6. Network & Infrastructure

6.1 Network Integrity

You shall not take any action that interferes with, disrupts, or imposes an unreasonable burden on our network, servers, or infrastructure, including the equipment and networks of other CartOS Hosting customers and upstream providers.

6.2 IP Address Usage

IP addresses assigned to your account remain the property of CartOS Hosting and its upstream providers. You may not sell, transfer, or lease IP addresses. IP addresses may be reassigned or changed at our discretion with reasonable notice. You shall not use IP addresses in a manner that results in their being listed on public blacklists or reputation databases.

6.3 DNS & Domain Usage

You may not use CartOS Hosting DNS services to operate authoritative DNS for domains involved in illegal activities, phishing, spam, or other prohibited activities. You are responsible for maintaining accurate WHOIS registration information for all domains hosted on your account as required by ICANN and applicable domain registrar policies.

6.4 Backups & Data Integrity

While CartOS Hosting performs automated backups as a courtesy, you bear sole responsibility for maintaining independent backups of your data. We are not liable for data loss resulting from hardware failure, software errors, security breaches, account suspension, account termination, or any other cause.

7. Intellectual Property & Copyright

7.1 Your Obligations

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to host, display, and distribute all content on your account. You are solely responsible for ensuring that Your Content does not infringe the intellectual property rights of any third party.

7.2 DMCA Procedures

CartOS Hosting complies with the Digital Millennium Copyright Act (DMCA). If we receive a valid DMCA takedown notice regarding content hosted on your account, we will:

  • Promptly remove or disable access to the allegedly infringing content;
  • Notify you of the takedown and provide a copy of the notice;
  • Provide you with the opportunity to submit a counter-notification if you believe the takedown was issued in error;
  • Restore the content if a valid counter-notification is received and the original complainant does not file a court action within the statutory timeframe.

7.3 Repeat Infringers

CartOS Hosting will, in appropriate circumstances, terminate the accounts of customers who are determined to be repeat copyright infringers. Three or more valid DMCA takedown notices against a single account within any twelve (12) month period will be considered grounds for account termination.

7.4 Filing a DMCA Notice

To submit a DMCA takedown notice, please send a written communication to our designated DMCA agent at dmca@cart-os.com containing the information required by 17 U.S.C. § 512(c)(3).

8. Monitoring & Enforcement

8.1 Right to Monitor

CartOS Hosting reserves the right, but is not obligated, to monitor the Services for violations of this AUP. Monitoring may include automated scanning for malware, spam, or prohibited content; network traffic analysis for security threats or abuse patterns; and review of resource usage metrics. We do not routinely monitor the content of customer websites, databases, or email, but may do so when we have reason to believe a violation has occurred or when required by law.

8.2 Investigation

We may investigate any suspected violation of this AUP. During an investigation, we may suspend or restrict access to your account as a precautionary measure. We may cooperate with law enforcement agencies, regulatory authorities, or third parties in the investigation of suspected illegal activities, which may include disclosing account information and hosted content as required or permitted by law.

8.3 Discretion

Determinations regarding violations of this AUP are made at the sole and reasonable discretion of CartOS Hosting. We are not required to provide advance warning or notice before taking enforcement action, particularly in cases involving illegal content, security threats, or imminent harm to our infrastructure or other customers.

9. Consequences of Violations

CartOS Hosting may take any of the following actions, individually or in combination, in response to a violation or suspected violation of this AUP:

  • Warning: Issuing a written warning identifying the violation and requiring corrective action within a specified timeframe;
  • Content Removal: Removing, disabling, or quarantining specific content, files, scripts, or applications that violate this AUP;
  • Service Restriction: Throttling, limiting, or restricting specific services or features (e.g., email sending, database access, SSH access);
  • Account Suspension: Temporarily suspending your account and all associated services pending investigation or remediation;
  • Account Termination: Permanently terminating your account and deleting all associated data, with no refund of prepaid fees;
  • Legal Action: Pursuing civil or criminal remedies, including reporting illegal activities to appropriate law enforcement authorities;
  • IP Blacklisting: Blacklisting IP addresses or domains associated with your account.

For severe violations — including but not limited to CSAM, malware distribution, DDoS attacks, phishing, or other activities that pose an immediate threat — CartOS Hosting will terminate the account immediately without prior notice, without refund, and will report the activity to the appropriate authorities.

The severity of the enforcement action will be proportional to the nature, severity, and impact of the violation, the customer's history of compliance, and any applicable legal requirements. CartOS Hosting is under no obligation to provide a specific sequence of escalating responses and may proceed directly to suspension or termination for any violation at its sole discretion.

10. Reporting Violations

If you become aware of any activity or content hosted on CartOS Hosting that you believe violates this AUP or applicable law, we encourage you to report it to us immediately. Reports can be submitted to:

Please include as much detail as possible in your report, including URLs, IP addresses, timestamps, screenshots, email headers, and a description of the alleged violation. We will review all reports and take appropriate action in accordance with this AUP and applicable law.

11. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in our practices, technologies, legal requirements, or industry standards. When we make material changes, we will update the "Last Updated" date at the top of this page and may provide additional notice through email or a prominent notice on our website. Your continued use of the Services after any changes to this AUP constitutes your acceptance of the revised policy. It is your responsibility to review this AUP periodically.
